Terms of Service

These terms are the agreement between Mololab, LLC, a Delaware limited liability company (“Molo Lab”, “we”, “us”), and the business that uses MoloPilot (“you”). They cover our website at molopilot.com, the MoloPilot app, and everything MoloPilot does for you. You accept them when you sign in, subscribe or use MoloPilot.
In short
- MoloPilot is software that runs advertising on your own Meta account, inside the boundaries you set. It is not an agency, and it cannot guarantee results.
- You remain the advertiser. Your advertisements, your advertising account and your ad spend are yours, and Meta bills you for advertising directly.
- Plans renew every month until you cancel. Cancelling stops the next charge, and MoloPilot keeps working until the end of the period you paid for.
- Payments are not refunded, except as our Refund Policy says, for example for a charge made in error.
- Disputes are settled individually, by arbitration under Delaware law, and never in class actions.
The sections below are what apply.
1. Who can use MoloPilot
MoloPilot is for businesses. You may use it only for your trade, business or profession, and not as a consumer. If you use it for a company, you confirm that you may accept these terms for that company, and “you” means the company. You must be at least 18.
Our Refund Policy is part of these terms. Our Privacy Policy explains how we handle personal data. When MoloPilot asks for your agreement to something specific, such as using your Instagram posts, that agreement is part of these terms too.
You may not use MoloPilot if you are located in, or organized under the laws of, a country or region subject to comprehensive United States sanctions, or if you are on a United States government list of restricted parties.
2. What MoloPilot does
MoloPilot is automated software. It reads the product information you give it, plans and makes advertisements, publishes them on the Meta advertising account you connect, watches how they perform, and changes budgets, pauses and starts advertisements, and makes new ones, within the boundaries you set. It keeps working on its own schedule, without being asked each time, and records what it did and why in your workspace’s activity log.
MoloPilot is not an advertising agency, a media buyer or a consultant. No person at Molo Lab plans or runs your campaigns, and we never buy advertising for you.
We keep improving MoloPilot, so its features change. If we remove something central to the plan you pay for, we will tell you in advance, as Changes to these terms describes. A feature marked as coming soon, or offered as a preview, is provided as it is and may change or end.
3. Your account
You sign in with a Google account. Anyone who can sign in to that account can use your workspace, so keep it secure. You are responsible for what happens in your workspace and for keeping the information in it accurate. Tell us straight away at support@molopilot.com if you think someone has used it without your permission.
Do not share an account, resell access to MoloPilot, or create more than one workspace to take more than one free trial.
4. Your advertising account
To advertise, you connect a Meta advertising account and a Facebook Page that you are allowed to use. By connecting them, you authorize MoloPilot to read them and, within your boundaries, to create, publish, change, pause and start campaigns, ad sets and advertisements on them for you. You can disconnect at any time in MoloPilot under Connections, or remove MoloPilot in your Facebook settings.
MoloPilot never changes how your advertising account pays Meta, never changes the account’s settings, never deletes advertising history, and never touches a campaign marked Don’t Touch. Campaigns MoloPilot did not create are Don’t Touch until you hand them over.
You remain the advertiser. Your advertisements run under your advertising account and your Page, and you are responsible for them, and for following Meta’s terms and advertising policies, as if you had published them yourself. Meta decides whether to approve an advertisement, and can reject advertisements, limit their delivery or restrict an account. We do not control those decisions and are not responsible for them.
Your advertising spend is between you and Meta. Meta charges the payment method on your advertising account directly. Molo Lab never receives, holds or pays your advertising money, and cannot refund it. If Meta stops running your account’s advertisements because of a payment problem, MoloPilot stops for the products that use the account, and starts again by itself once the payment is fixed on Meta.
When MoloPilot asks who your advertisements in the European Union are for and who pays for them, the answer you give or confirm is your own statement, and you are responsible for it being true.
5. Boundaries and autonomy
For each product, you set the boundaries MoloPilot works within: a daily budget, where it may and may not advertise, the campaigns it must not touch, and how much it decides alone. MoloPilot checks every change against your boundaries in software before it reaches your advertising account, and refuses any change that would cross one.
In Autopilot, you authorize MoloPilot to act without asking you first, including publishing advertisements, starting them, and changing budgets within your daily budget. In Copilot, the kinds of change that need your approval wait for you. In Paused, MoloPilot changes nothing. You can change mode, pause, or turn MoloPilot off at any time.
Your daily budget limits the daily budgets MoloPilot sets on your account. It does not control how Meta delivers them: Meta may spend more than a daily budget on some days and less on others, under its own terms. It also does not limit campaigns you run yourself or keep as Don’t Touch. Set a budget you are willing to spend every day, because MoloPilot is designed to put it to work.
MoloPilot can be wrong. It decides from the information it has, and advertising is uncertain. Read your activity log and reports, and tell us if something looks wrong.
6. Your content
Your content is everything you or your connected accounts give MoloPilot: the websites and store listings you add, the files you upload, what you type or correct, your Instagram posts if you let MoloPilot use them, and information from the accounts you connect. You keep all rights in your content.
You give us a worldwide, non-exclusive, royalty-free permission to host, copy, process, adapt and display your content, and to share it with our service providers, only as needed to provide MoloPilot to you, including to publish advertisements on your accounts. The permission ends when the content is deleted, except for copies the law requires us to keep, and for advertisements already published, which stay on your advertising account.
You confirm that you have the rights and permissions needed for MoloPilot to use your content in advertising, including permission from anyone who appears in your photos, videos or posts, and that what you tell MoloPilot about your business is true.
If you turn on Use my Instagram posts, MoloPilot may run your posts as advertisements as they are, use their photos to make new advertisements, and learn from them how your brand speaks. Turning it off stops all of this and deletes what MoloPilot imported from Instagram.
7. The advertisements MoloPilot makes
MoloPilot uses AI to write and make advertisements, including words, pictures and video, from your content. As between you and us, the advertisements made for you are yours, and we assign to you any rights we have in them. Material made with AI may not be protected by copyright in every country, and something similar may be made for others, so we cannot promise that an advertisement is unique or that you can stop others from using something like it.
MoloPilot checks the advertisements it makes before they run: the words on them must be spelled exactly, the product must look like yours, and it refuses terms your brand forbids, competitors’ names, numbers your own material does not support, and invented testimonials. These checks reduce mistakes, but they cannot catch everything, and they do not take away your responsibility for what runs under your name. If you see an advertisement you do not want, pause it in MoloPilot or tell us.
To learn what works in your market, MoloPilot reads advertisements that other businesses have made public in Meta’s Ad Library. It borrows their structure, never their brand, words or pictures.
8. Acceptable use
You may not use MoloPilot to:
- advertise anything that is illegal where it is shown, or that Meta’s advertising policies prohibit;
- advertise housing, employment, credit or other financial products and services, or anything about social issues, elections or politics. Meta treats these as special categories, and MoloPilot does not run advertising in them;
- make false or misleading claims, or impersonate any person or business;
- use content you do not have the right to use;
- discriminate against people, or target or exclude them unlawfully;
- put sensitive personal data into MoloPilot that it does not need, such as health information, government identifiers or financial account numbers;
- interfere with MoloPilot or the services it uses, try to reach what you are not allowed to, copy, scrape or reverse engineer it, or get around its limits, your plan’s limits or the free trial rules.
We may refuse, pause or remove anything that breaks these rules, and suspend your workspace, as Suspension and ending describes.
9. Plans, trials and payments
Plans and prices
Plans and their prices are on our pricing page, and in MoloPilot when you choose a plan. Prices are in US dollars unless the checkout shows another currency, and they exclude taxes, which are added where the law requires.
Monthly renewal
A plan is a subscription paid monthly in advance. It renews automatically every month at your plan’s current price until you cancel, and you authorize us to charge your payment method each month until then.
Free trials
Some plans start with a free trial. MoloPilot says whether yours does, and for how long, before you subscribe. Nothing is charged during the trial. When it ends, your plan starts and the first month is charged automatically, unless you cancelled before. A free trial is available once per workspace, once per website and once per Meta advertising account, and MoloPilot tells you before you pay if yours is not eligible. Plans without a free trial, such as Scale, are charged on the day you subscribe.
Changing plan
You can change plan in MoloPilot under Billing. A change that costs more can start now, in which case the difference for the rest of the current period is charged straight away, or at your next billing date. A change that costs less starts at your next billing date, and nothing is credited back for the current period. A change is refused while your workspace uses more than the new plan allows.
Credits
Credits pay for generating images and video. Each paid month of your plan includes the credits shown for it, and you can buy more as a one-time purchase that never renews. Credits are held when MoloPilot starts making something and used when the result passes its check; if it fails, they return to your balance. Credits do not expire while you have a plan. Without one, they are kept but cannot be used. Credits have no cash value, cannot be exchanged for money or moved to another workspace, and end when the workspace is deleted. Everything else MoloPilot does is covered by your plan and never costs credits.
How you pay
Payments are processed by Stripe, and we never receive or store your card number. Some purchases are sold through Link, a Stripe company, acting as the reseller. When that applies, your checkout and receipt say so, the charge appears on your statement as LINK.COM followed by our name, and Link’s own terms also apply to the payment.
Late payment
If a payment fails, it is tried again. While it is overdue, MoloPilot stops operating your advertising and your credits cannot be used. If it stays unpaid, we may end your subscription.
Price changes
We may change our prices. We will tell you at least 30 days before a new price applies to you, and it applies from your next billing date after that. If you do not agree, cancel before then.
Cancelling and refunds
You can cancel at any time, and your plan then ends at the end of the period you have paid for. Payments are not refunded, except as our Refund Policy says. If a payment is refunded or reversed, including through a card dispute, the period and the credits it paid for end, and we may remove the credits it granted that you have not used. If you think a charge is wrong, contact us first at support@molopilot.com so we can put it right quickly.
10. Other companies’ services
MoloPilot works with services run by other companies: Meta (Facebook and Instagram) for advertising, Google for sign-in, Stripe and Link for payments, and Slack if you connect it for reports. Their own terms and policies govern your use of them, and you are responsible for following them. We are not responsible for those services, for changes they make (which can change what MoloPilot can do), or for their decisions about your accounts.
11. Privacy and data protection
Our Privacy Policy explains how we collect and use personal data.
Some data you bring into MoloPilot is about other people, such as the people in your photos and posts, or the colleagues you add to receive reports. For that data you are the controller and we are your processor, and we will:
- process it only to provide MoloPilot to you, following your instructions, which these terms and your use of MoloPilot set out;
- make sure everyone who can access it is bound to keep it confidential;
- protect it with appropriate technical and organizational measures;
- use only service providers bound by data protection obligations as protective as these, stay responsible for them, and tell you about changes to them by updating our Privacy Policy;
- help you answer people exercising their data protection rights, and with your own security and data protection obligations, as far as MoloPilot reasonably can;
- tell you without undue delay after we learn of a personal data breach that affects it;
- delete it when you delete it or your workspace, or when our agreement ends, unless the law requires us to keep it; and
- give you the information reasonably needed to show we meet these commitments.
You are responsible for having a lawful basis, and for giving any notice the law requires, for the personal data you bring into MoloPilot. If your law requires a separate data processing agreement, or standard contractual clauses for international transfers, email us and we will sign one with you.
12. Confidentiality and security
We treat what is in your workspace as confidential and use it only to provide MoloPilot to you. We never sell it, never show your content, results or lessons to another customer, and never use them to advertise anyone else’s product. We may use statistics about how MoloPilot runs, which do not identify you, your products or your customers, to keep it working and to improve it.
We protect your data with measures suited to it, including encryption in transit and encryption of the credentials for the accounts you connect. No system is perfectly secure, and you are responsible for the security of your own Google and Meta accounts.
13. Suspension and ending
You can stop using MoloPilot and cancel your plan at any time, as our Refund Policy describes, and ask us to delete your account, as our Privacy Policy describes.
We may suspend or end your access, or part of it, if you break these terms, do not pay, use MoloPilot in a way that could harm others, us, or the services MoloPilot works with, or if the law, a court or one of those services requires it. Where we reasonably can, we will tell you first and give you a chance to put it right.
We may also stop offering MoloPilot, or end these terms for a reason that is not your fault. If we do, we will give you at least 30 days’ notice and refund the unused part of any period you have paid for.
When your access ends, MoloPilot stops operating your advertising. It does not pause or delete anything on your advertising account: advertisements that are running keep running, and Meta keeps charging you for them, until you pause them. Whatever by its nature should outlast these terms does, including amounts owed, ownership, the limits on our responsibility, your indemnity and how disputes are settled.
14. No guarantees
We work hard to make MoloPilot reliable, and we provide it as it is and as available. To the fullest extent the law allows, we disclaim every warranty not set out in these terms, including warranties of merchantability, fitness for a particular purpose and non-infringement.
We do not guarantee any advertising result: not sales, leads, clicks, reach, cost per result or return on spend. We do not guarantee that Meta will approve an advertisement or keep an account open, that MoloPilot will be uninterrupted or free of errors, or that material made with AI will be accurate, original or fit for your purpose.
15. Limits on liability
To the fullest extent the law allows:
- neither of us is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data, even if told they were possible;
- we are not liable for money you pay Meta or any other advertising platform, including spend you believe MoloPilot caused; and
- our total liability for all claims about MoloPilot or these terms is limited to the greater of what you paid us in the 12 months before the event the claim is about, and US$100.
These limits do not apply to your obligation to pay us, to your indemnity, or to any liability the law does not allow to be limited.
16. Your indemnity
You will defend us and our members, employees and contractors against any claim by a third party, and pay the losses and costs that result, including reasonable legal fees, arising from your content, your advertisements, your products or business, or your breach of these terms, of the law, or of Meta’s terms and policies.
17. Changes to these terms
We may update these terms. If a change is material, we will tell you by email or in MoloPilot at least 30 days before it takes effect, unless the law or a service MoloPilot depends on requires it sooner. If you keep using MoloPilot after a change takes effect, the new terms apply; if you do not agree, cancel before then. A change does not apply to a dispute that arose before it.
18. Disputes
Talk to us first
Most problems can be solved quickly. Before starting a claim, email support@molopilot.com describing it, and we will both try in good faith to settle it within 30 days.
Governing law
These terms, and any dispute about them or about MoloPilot, are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Arbitration
Any dispute we cannot settle informally will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before a single arbitrator. The arbitration will be in English, its seat will be Wilmington, Delaware, and hearings will be held by video, or the dispute decided on written submissions, wherever the rules allow, so that neither of us has to travel. Judgment on the award may be entered in any court with jurisdiction.
Exceptions
Either of us may bring an individual claim in a small claims court that has jurisdiction, and either of us may ask a court to stop the misuse of its intellectual property or confidential information.
Individual claims only
Claims may be brought only individually, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. An arbitrator may not consolidate claims or award relief to anyone but the individual parties. If this paragraph cannot be enforced for a claim, that claim must be heard in the state or federal courts located in Delaware, and not in arbitration. Where a claim is heard in court, both of us waive a jury trial.
Time limit
A claim must be brought within one year after it arose, unless the law requires a longer period.
19. General
These terms, with the documents they refer to, are the whole agreement between us about MoloPilot and replace anything agreed before. If any part cannot be enforced, the rest still applies. If we do not enforce a right, we have not given it up.
You may not transfer these terms without our written consent. We may transfer them to a company that takes over MoloPilot or our business. Neither of us is responsible for a failure caused by events beyond reasonable control, such as an outage at a provider MoloPilot depends on. We are independent parties, and these terms give no rights to anyone else.
We send notices to the email address you sign in with, and you send them to support@molopilot.com. These terms are written in English, and the English version applies if they are translated.
